Information for owners planning new construction, remodeling, exterior modifications, or other improvements within Punta Piedra.

Important: Do not begin construction until all required Association and municipal approvals have been obtained. Municipal approval does not replace HOA approval, and HOA approval does not replace required governmental permits.

Before You Begin

Construction and exterior improvements require review and approval by the Punta Piedra Architectural Committee.

Owners must be current on Association dues before a project will be accepted for review. Project plans must be submitted for Architectural Committee review and approval before construction begins.

All construction must also comply with applicable federal, state, and municipal laws and permitting requirements.

What Requires Approval?

Architectural Committee approval is required for new construction and for a broad range of exterior improvements or alterations, including:

  • additions and structural modifications
  • walls, fences, and gates
  • exterior color changes
  • driveways and sidewalks
  • exterior lighting
  • irrigation and landscaping
  • roof-mounted equipment
  • other exterior improvements or changes

Plans must show the nature, location, dimensions, materials, and colors of the proposed work.

Changes to previously approved plans must also be submitted for approval before they are constructed.

Submitting a Project

The Construction Regulations require project plans in:

  • AutoCAD / ACAD format
  • PDF format
  • one full-size paper set
  • property boundary information
  • official property number

Outstanding Association dues must be resolved before the project will be accepted for review.

Before construction begins, owners must also provide:

  • proof of a valid municipal building permit
  • stamped municipal plans for the Association’s records

Fees & Construction Deposit

Requirement Amount
Plan / project review fee USD $600, non-refundable
Construction deposit USD $2,000 or equivalent in MXN

The construction deposit may be used to address common-area damage, unauthorized modifications, and safety or environmental issues arising during construction. Unused funds are returned following final inspection and approval.

Construction Hours

Construction activities are permitted during the following hours:

  • Monday–Friday: 8:00 AM–5:00 PM
  • Saturday: 8:00 AM–12:00 PM
  • Sundays and holidays: No construction work

Administration may grant written exceptions for urgent repairs or safety issues.

Site Requirements

During construction, owners are responsible for maintaining appropriate site conditions, including:

  • portable sanitary facilities for workers
  • erosion control to prevent debris or runoff onto streets and sidewalks
  • a dedicated container for construction waste
  • prompt removal of construction waste
  • utility connections that comply with applicable municipal and utility requirements

Community trash receptacles may not be used for construction waste. The Association does not provide utilities for construction projects.

Each project must also designate a Construction Supervisor or Responsible Party who serves as the primary contact with the Association and is responsible for on-site compliance.

Architectural Standards

The Construction Regulations contain detailed requirements concerning:

  • architectural style and exterior materials
  • exterior colors
  • building height
  • setbacks
  • walls and fences
  • parking
  • landscaping
  • roof-mounted equipment
  • exterior modifications
  • protection of neighboring properties and views

Owners and their architects should review the complete Construction Regulations before preparing plans.

Project Timelines

Approved plans that are not acted upon within six months must be resubmitted for approval.

Once construction begins, the Construction Regulations establish a 24-month construction period.

Changes During Construction

Construction must follow the plans approved by the Architectural Committee. Unauthorized changes may result in enforcement action and may be corrected using the construction deposit.

Failure to comply with the Construction Regulations or an approved addendum may result in:

  • suspension of construction activity
  • use of the construction deposit to correct violations
  • fines approved by the General Assembly
  • denial of final approval or occupancy clearance

Except in cases involving an immediate risk to persons or property, the owner will receive written notice and will have five business days to correct the violation unless another period is specified.

Neighboring Property

If construction requires temporary use of an adjacent privately owned lot, the arrangement is between the affected property owners.

Written proof of the neighboring owner’s consent must be provided to Administration. The Association is not a party to the agreement and assumes no responsibility for it.

Temporary use of neighboring property generally may not exceed 12 months without written approval. Owners are responsible for preventing damage and restoring any affected property to its original condition.

Completion & Final Inspection

At the completion of construction, a final inspection is required to confirm compliance with applicable construction requirements and identify any damage or unresolved site or utility issues.

Owners must also submit final “as-built” plans and specifications within 30 days after completion of approved construction or improvement work.

Construction Documents

The 2026 Addendum supplements, but does not replace, the architectural standards, setbacks, heights, and design criteria established in the 2022 Construction Regulations. The Spanish version of the Addendum is the official and binding version.
