Why This Has Been Difficult
The Board has been working for more than a year to evaluate paths for collecting outstanding balances.
This remains a top priority.
Outstanding balances remain owed to the Association, and owners with delinquent accounts should contact the office to make payment arrangements.
The challenge is not lack of effort. The challenge is finding a path that is legally sound, financially responsible, and likely to produce results within a useful timeframe.
The Association has met with and consulted various attorneys regarding delinquent accounts. The legal process in Mexico is complex. Collection actions often require significant upfront legal fees, filing costs, document review, and time.
Many attorneys also require contingency fees on collected amounts.
That means the Association must consider not only whether a claim may be valid, but whether the likely recovery justifies the legal cost, delay, and uncertainty.
Legal action can take months or years. Results are not guaranteed.
Given the Association’s current budget constraints, it would not be responsible to spend limited operating funds on legal action unless there is a clear and practical strategy.
That does not mean the Association is abandoning collections.
It means collections must be pursued carefully, with accurate records, proper legal review, and a realistic understanding of cost and timing.
The Board will continue evaluating legal options and will move forward where appropriate.
